EVENT TERMS & CONDITIONS
THE WARHORSE MUSTER: 20 – 22 September 2024
By participating in The Warhorse Muster (“Event”), all participants agree to the following terms and conditions set forth by Motology Films (“Event Provider”):
Acknowledgment of Risk
Participants acknowledge that motorcycle activities are inherently risky. By participating in this Event, participants willingly expose themselves to potential risks, including personal injury, disability, death, and property damage. All such risks are accepted and the Participant will not hold Motology Films or Grabbo’s Trail & Track responsible for any such damage, death, loss or harm that occurs as a consequence of participation in the Event.
Nothing in these Terms & Conditions shall imply the creation of any legal relationship between the Participant and Motology Films or Grabbo’s Trail & Track.
You are responsible for the arrangements and costs of your own travel, including but not limited to airfares, visas, visa applications, insurance and transport to the Event. Refer to the agenda for the Event for a comprehensive list of the program’s inclusions and exclusions.
Safety Equipment
Participants are required to wear appropriate safety gear at all times during the Event, including an approved motorcycle safety helmet, full-length riding jacket and pants with protective inserts, and full-length motorcycle boots with shin and ankle support. Additional safety requirements specified by the Event Provider must also be adhered to, or the Participant will be prohibited from taking part in the Event.
Motorcycle Condition
Any motorcycle used during the Event must be registered, insured, roadworthy, and in safe condition, meeting the requirements set by the Event Provider. The Event Provider reserves the right to refuse participation if the motorcycle does not comply.
Release of Liability
The Event Provider, its employees, agents, contractors, and associated third parties are released from any liability for death, personal injury, disability, loss, or property damage arising from participation in the Event, except as prohibited by law.
Indemnity
Participants indemnify the Event Provider, its employees, agents, contractors, and associated third parties against any liability, claims, costs, expenses, and demands arising from participation in the Event, except as prohibited by law.
Eviction and Non-compliance
The Event Provider reserves the right to evict or refuse participation for non-compliance with these Terms and Conditions or at their discretion. In such cases, no refund will be provided.
Operation and Control
Participants are responsible for the safe operation and control of any motorcycle used during the Event. Applicable rules and Event Provider instructions must be followed, and participants must not operate the motorcycle under the influence of alcohol or other intoxicating substances or engage in any racing.
Remote Area
Participants acknowledge that the Event is in a rural area with limited medical or emergency support. Any pertinent medical conditions must be communicated to the Event Provider prior to the Event commencing
Incident Reporting
Participants must notify the Event Provider immediately if any incident or accident occurs during the Event.
Licensing and Payment
Only participants holding a full and current motorcycle license, and who have paid the Event fee in full, are entitled to participate. A booking is confirmed only after full payment is received by the Event Provider. Submitting an expression of interest application does not guarantee a place in the Event.
Insurance
Participants must have appropriate insurance, including ambulance insurance and motorcycle insurance that covers dirt roads. Participants are responsible for ensuring that they have the necessary insurance coverage, including travel insurance where necessary.
Event Changes
The Event Provider reserves the right to postpone, cancel or modify the Event without notice and without any liability to the Event Provider. Refunds of fees paid, if any, are at the discretion of the Event Provider.
Withdrawal and Cancellation Fees
Participants may withdraw from the Event by notifying the Event Provider in writing. A cancellation fee applies as follows:
– $150 administration fee if 30 days or more notice is given.
– 50% of the registration fee plus a $150 administration fee if 15-29 days notice is given.
– 100% of the registration fee if 14 days or less notice is given.
Transfer of Rights
The Event Provider may transfer its rights and obligations under these Terms and Conditions to an alternative supplier.
Personal Information
The Event Provider collects personal information to conduct the Event. Failure to provide the requested information may result in being unable to attend. Requests to access, update, or correct personal information should be directed to the Event Manager. The Event Provider may also use or disclose your personal information for a purpose related to that for which it was collected, including communications about future events of a similar nature to the event. You may request to delete this information from our database at any time post the Event by contacting the Event Provider.
Media Consent
Participants consent to the Event Provider using their name, likeness, image, and voice in any media for an unlimited period without remuneration for promoting the Event and associated products.
Photography and Video Footage
Photography and video footage taken by participants at the Event are for personal use only unless prior permission is obtained.
Severability
If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, that specific provision will be modified to the minimum extent necessary to make it valid and enforceable. If modification is not possible, the invalid or unenforceable provision will be removed, but the rest of the contract will remain fully effective and enforceable.
Third-Party Rights
Any commitment made in these Terms and Conditions that benefits a third party is enforceable by that third party under applicable law.
